DrWheelz Auto Service Private Limited reserves the right to change or revise the terms and conditions of this Agreement at any time by posting any changes or a revised Agreement on this Website. DrWheelz Auto Service Private Limited will alert you that changes or revisions have been made by indicating on the top of this Agreement the date it was last revised. The changed or revised Agreement will be effective immediately after it is posted on this Website. Proprietary Rights. DrWheelz Auto Service Private Limited has proprietary rights and trade secrets in the Products. You may not copy, reproduce, resell or redistribute any Product manufactured and/or distributed by DrWheelz Auto Service Private Limited . DrWheelz Auto Service Private Limited also has rights to all trademarks and trade dress and specific layouts of this webpage, including calls to action, text placement, images and other information.

GST: If you purchase any Products, you will be responsible for paying any applicable GST.

PART B TERMS APPLICABLE TO CUSTOMERS

Part B of these Terms of Use sets out certain terms and conditions which are applicable to any person registering as a Customer and using the Services of DrWheelz

1. Registering as a Customer

In order to benefit from all the features of the Services available you will need to request for service by web form or by calling the call center. You will be asked to provide certain information about yourself including your name, contact details and vehicle information. You must ensure that the information provided by you is correct, complete and not misleading. You should also inform us promptly of any changes to the information that you have provided, by updating your details, so we can communicate with you effectively. By registering as a customer, you are issuing your consent to adhere to the terms and conditions.

2. Provision of Payment Platforms to Customers

Some services made available for booking to you include the opportunity to make payments facilitated through our service. Such payments will be made using trusted third party payment gateways.

By making a payment through DrWheelz, you undertake that the credit or debit card details, or third party wallet login credentials that you provide are for your own credit or debit card, or wallet account, and that you have sufficient funds to make the payment for the services booked.

We reserve the right to alter prices or services or cease to list services at any time, without prior notice or warning.

The total price shown for services is inclusive of the items described for that service and may not include additional services found to be required at the time of availing your service. In such a case the DrWheelz will discuss any change in scope with you and additional agreements or payments where required are made between you and DrWheelz.

Payment options provided may differ between service providers, and services offered. In cases where cash on delivery (COD) is not available as an option, full payment must be made for through a payment option offered to you before services are provided to you.

In cases where cash on delivery (COD) is offered and selected as a payment method, full payment must be made directly to the service provider at the time of service completion.

In cases where a form of online payment is offered and selected you must complete the payment in full to successfully make the booking. Payment details provided are not stored by DrWheelz and are encrypted by the payment provider selected to ensure security.

If you decide to cancel your appointment, you may do at any time, preferably by phone, quoting your order number, or in the Mobile Application.

If we accept your cancellation, no cancellation fee will be charged, for refund policy, kindly refer to the refunds section of the page.

3. Warranty

we have 6 months labour warranty on everything we do with a maximum liability of INR 5000. If a customer request for a rework and if the rework is a false call or not related to the work done previously then customer will be liable to pay labour and parts charge for it and if the customer doesn't want to take the service then the minimum visit charge has to be paid by the customer.

4. Our Responsibilities to you

We will provide DrWheelz Services to you using reasonable skill and care and in accordance with these Terms of Use. However, if you use the DrWheelz Services as a Customer you acknowledge and agree that the services we provide are subject to the following limitations and disclaimers:

You authorize all the jobs to be executed using the required material, and that your vehicle will be stored, driven and repaired at your risk. All the authorized work will be performed with necessary spares, at your cost and any additional work to be carried out at your cost. The vehicle will be held, operated, serviced and returned to you at your risk. Any service deemed necessary will be carried by appropriate tools and spareparts as per the need.

PART C – GENERAL TERMS APPLICABLE TO ALL USERS

Part D of these Terms of Use set out certain terms and conditions which are applicable to all users of this platform including Customers and Partners

1. Passwords and Security

If you register to use DrWheelz Services you will be given a username and password. You must keep your ID confidential and must not disclose it or share it with anyone. You are responsible for preventing unauthorized use of your ID.

If you believe there has been a breach of security such as the disclosure, theft or unauthorized use of your ID, you must notify us immediately. If we reasonably believe that your ID is being used in any way which is not permitted by these Terms of Use, we reserve the right to suspend access rights immediately on giving notice to you and to block access from your ID until the issues has been resolved.

2. Disclaimers

Whilst we endeavor to ensure that the information available on or through DrWheelz is correct, up to date and accurate we do not warrant the accuracy and completeness of such material. In particular (but without limitation), DrWheelz permits you to access and receive information supplied by third parties. The third parties submitting this information are responsible for ensuring that material submitted is accurate and complies with relevant laws and codes. We will not be responsible to you for the conduct of any such third party or for any error or inaccuracy in any material they supply.

Although we aim to offer you the best service possible, we make no promise that Services will meet your requirements. We cannot guarantee that Services will be fault free or continuously available.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THIS WEBSITE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

Nothing in these terms of use shall exclude or limit our liability for death or personal injury due to our negligence or for fraudulent misrepresentation or for any other liability which can not be excluded or limited under applicable law. Your statutory rights as a consumer are not affected by these Terms and Conditions.

4. Termination of Services

We may suspend or cancel your registration and/ or terminate your access to DrWheelz if you are in breach of these Terms of Use or have made improper use of The Services.
You may cancel your registration at any time by informing us in writing. If you do so you must stop using The Services.

The suspension, cancellation or termination of your registration and your right to use The Services shall not affect either party`s statutory right or liabilities.

5. Intellectual Property

Unless otherwise stated, the copyright, database right and other intellectual property rights in DrWheelz (including without limitation all content, materials and technology used or appearing or transmitted through it) belongs to us or our licensors. All rights are reserved.

6. General

All notices shall be given to us via email or by post using the contact details set out in the Contact Us section, or to you at either the email or postal address you provide during registration.

We may revise these Terms of Use at any time. You are expected to check these Terms of Use from time to time to take notice of any changes we make as they are legally binding on you. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on our website.

7. Applicable Law

These Terms and Conditions will be subject to the laws of Karnataka India and the courts shall have jurisdiction to resolve any disputes between us.

8. GENERAL

Force Majeure. DrWheelz Auto Service Private Limited will not be deemed in default hereunder or held responsible for any cessation, interruption or delay in the performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, or boycott.

Cessation of Operation. DrWheelz Auto Service Private Limited may at any time, in its sole discretion and without advance notice to you, cease operation of the Website and distribution of the Products.

Entire Agreement. This Agreement comprises the entire agreement between you and DrWheelz Auto Service Private Limited and supersedes any prior agreements pertaining to the subject matter contained herein.

Effect of Waiver. The failure of DrWheelz Auto Service Private Limited to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

Governing Law; Bangalore Jurisdiction. This Website originates from the Bangalore, Karnataka. This Agreement will be governed by the laws of the State of Karnataka without regard to its conflict of law principles to the contrary. Neither you nor DrWheelz Auto Service Private Limited will commence or prosecute any suit, proceeding or claim to enforce the provisions of this Agreement, to recover damages for breach of or default of this Agreement, or otherwise arising under or by reason of this Agreement, other than in courts located in State of Karnataka.  By using this Website or ordering Products, you consent to the jurisdiction and venue of such courts in connection with any action, suit, proceeding or claim arising under or by reason of this Agreement. You hereby waive any right to trial by jury arising out of this Agreement and any related documents.

Statute of Limitation. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website or Products or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Waiver of Class Action Rights. BY ENTERING INTO THIS AGREEMENT, YOU HEREBY IRREVOCABLY WAIVE ANY RIGHT YOU MAY HAVE TO JOIN CLAIMS WITH THOSE OF OTHER IN THE FORM OF A CLASS ACTION OR SIMILAR PROCEDURAL DEVICE. ANY CLAIMS ARISING OUT OF, RELATING TO, OR CONNECTION WITH THIS AGREEMENT MUST BE ASSERTED INDIVIDUALLY.

Termination. DrWheelz Auto Service Private Limited reserves the right to terminate your access to the Website if it reasonably believes, in its sole discretion, that you have breached any of the terms and conditions of this Agreement. Following termination, you will not be permitted to use the Website and DrWheelz Auto Service Private Limited may, in its sole discretion and without advance notice to you, cancel any outstanding orders for Products. If your access to the Website is terminated, DrWheelz Auto Service Private Limited reserves the right to exercise whatever means it deems necessary to prevent unauthorized access of the Website. This Agreement will survive indefinitely unless and until DrWheelz Auto Service Private Limited chooses, in its sole discretion and without advance to you, to terminate it.

Domestic Use. DrWheelz Auto Service Private Limited makes no representation that the Website or Products are appropriate or available for use in locations outside India. Users who access the Website from outside India do so at their own risk and initiative and must bear all responsibility for compliance with any applicable local laws.
Assignment. You may not assign your rights and obligations under this Agreement to anyone. DrWheelz Auto Service Private Limited may assign its rights and obligations under this Agreement in its sole discretion and without advance notice to you.
